Agreement to these terms

These terms are an agreement between you and Misam Trading, Inc. (“Misam,” “we,” “us”) about your use of misam.co and its related services (the “Services”). By using the Services, you agree to these terms and to our Privacy Policy. If you use the Services for an organization, you agree for that organization and confirm you have authority to do so. If you have a separate written agreement with us for the Services, that agreement governs where it conflicts with these terms.

About Misam

Misam is an online store that sells Korean beauty and personal-care products. We sell to customers in the United States and ship only to U.S. addresses. We describe each product as accurately as we can, but colors on screen and packaging can vary. The ingredients and directions on the product's packaging are authoritative.

Cosmetics, not medicine. Most of our products are cosmetics and personal-care items. Nothing on this site is medical advice or a claim to treat, cure, or prevent any condition. Patch-test new products and stop using a product if irritation occurs. If you have a skin condition or allergy, consult a professional.

Sunscreens. In the United States, sunscreen is regulated as an over-the-counter drug, not a cosmetic. We sell sunscreens in their original, sealed manufacturer packaging and make no claims beyond the manufacturer's labeling. Always follow the directions printed on the product.

Who may use the Services

You must be at least 18 years old, or the age of majority where you live, to use the Services, and not barred from using them under applicable law.

Accounts

If the Services need an account, give accurate information and keep it up to date. Keep your sign-in details secure; you are responsible for activity under your account. Tell us promptly if you believe someone has used your account without permission.

Acceptable use

Do not use the Services to:

• break the law or infringe anyone's rights;
• upload or send malware, spam or content you have no right to share;
• interfere with, disrupt, or put an unreasonable load on the Services;
• get around security, access controls or usage limits;
• access the Services by automated means, except through features we provide for that purpose;
• copy, reverse-engineer or resell the Services, except where the law allows despite this term;
• build a competing product, or train models on the Services or their output, without our permission;
• impersonate anyone or misrepresent your affiliation; or
• harass, threaten or harm others.

Purchases, subscriptions and payment

Prices, taxes, billing periods and renewal terms are shown at checkout or in your order. By completing a purchase, you authorize us and our payment providers to charge your payment method for it. Subscriptions renew automatically until you cancel; you can cancel at any time, and cancellation takes effect at the end of the current billing period. We will tell you before a price change applies to your next renewal. Except as stated at checkout or required by law, payments are non-refundable.

Orders

An order is an offer to buy, which we may accept or decline, for example if we suspect fraud, a price is wrong or an item is out of stock. If we cancel an order you have paid for, we refund the charge. Delivery, returns and refunds follow our Shipping Policy and Returns & Refunds Policy, which are part of these terms. Automatic renewal, where offered, is disclosed at checkout and can be cancelled online. To change or cancel an order, email [email protected] as soon as you can with your order number; once an order has shipped, the Returns & Refunds Policy applies.

Your content

You keep ownership of content you upload, create or submit through the Services (“your content”). You give us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, display and transmit your content as needed to operate, provide, secure and improve the Services and to do what you ask of them. You are responsible for your content and confirm you have the rights needed to use it with the Services. We may remove content that we reasonably believe breaks these terms or the law. If you send us feedback, we may use it without obligation to you.

Our Services and intellectual property

The Services, including their software, design, text, photos and trademarks, belong to Misam Trading, Inc. or its licensors. Product names and brands belong to their owners. We give you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal use under these terms. We reserve all rights not expressly granted.

Third-party services

The Services may link to or work with services we do not control. Their own terms and policies apply, and we are not responsible for them.

Changes to the Services

We may add, change, suspend or remove features of the Services at any time.

Suspension and termination

You may stop using the Services at any time and ask us to close your account. We may suspend or end your access if you break these terms, if we must for legal reasons, or if your use puts the Services, other users or us at risk. Sections that by their nature should survive termination will survive, including your content license for any content retained as the law requires, disclaimers, limitation of liability, indemnity and governing law.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE. The Services do not provide legal, medical, financial or regulatory advice. You are responsible for how you use the Services and the products you buy, and for meeting any legal or regulatory obligations that apply to you.

Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, MISAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA, ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR US$100. Some jurisdictions do not allow some of these limits, so they may not apply to you.

Indemnity

To the extent the law allows, you will defend and indemnify Misam against third-party claims, and related losses and costs, arising from your content, your use of the Services in breach of these terms, or your breach of law.

California Proposition 65

For California residents: Some products sold on this site can expose you to chemicals known to the State of California to cause cancer or birth defects or other reproductive harm. For more information, go to www.P65Warnings.ca.gov. Where we know a specific product requires a chemical-specific warning, we show it on that product's page.

Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Texas, and you and we consent to their jurisdiction. You may also bring a claim in your local small-claims court. Nothing here limits rights you have under the law of where you live that cannot be waived.

Changes to these terms

We may update these terms from time to time. When we do, we will post the new version here and update the version and effective date above. If a change is material, we will give reasonable notice through the Services or by other appropriate means before it takes effect, unless it is needed sooner for legal, security or abuse-prevention reasons. If you keep using the Services after changes take effect, you accept them; if you do not agree, stop using the Services.

General

These terms, with any terms they refer to, are the whole agreement between you and us about the Services. If a part is unenforceable, the rest remains in effect. Our not enforcing a term is not a waiver. You may not transfer these terms without our consent; we may transfer them in a business transfer. We may send you notices electronically. Neither of us is responsible for delays caused by events beyond reasonable control.
